SMP Masters Inc. ("SMP Masters," "we," "us," or "our") respects the privacy of our clients, prospective clients, website visitors, and others who interact with us. This Privacy Policy explains how we collect, use, disclose, retain, protect, and otherwise process personal information in connection with our website at bestscalpmicro.com, consultations, scalp micropigmentation ("SMP") and related cosmetic services, appointment and booking activities, communications, treatment records, payment and transaction activities, and related business operations.

SMP Masters provides cosmetic scalp micropigmentation and related cosmetic pigmentation services. Because SMP involves the implantation of pigment into the skin using tattooing equipment, certain information and records may be collected and maintained in connection with applicable tattoo, body-art, health and safety, recordkeeping, insurance, legal, and regulatory requirements. SMP Masters does not provide medical diagnosis or treatment.

This Privacy Policy should be read together with the SMP Masters Terms of Service, Client Informed Consent and Treatment Agreement, applicable written booking terms, Aftercare Instructions, Final-Session Design & Touch-Up Acknowledgment, Single-Use Needle and Body-Art Confirmation, and other applicable notices, authorizations, or consents presented at the time information is collected. The Privacy Policy governs privacy and data-handling matters. A specific written authorization or acknowledgment concerning a particular use or treatment-specific matter controls with respect to the subject matter specifically addressed in that authorization or acknowledgment.

Scope

This Privacy Policy applies to personal information we collect online and offline in connection with SMP Masters, including through our website, consultation and contact forms, image uploads, telephone calls, email, text messages, booking and scheduling systems, payment and financing interactions, in-person consultations, treatment services, client records, and other direct interactions with us.

Third-party websites, platforms, payment processors, financing providers, scheduling services, social-media services, or other services that we do not control are governed by their own privacy policies and terms.

This Privacy Policy does not replace or modify any specific consent, authorization, acknowledgment, or disclosure required by applicable law for treatment, tattooing, body-art procedures, treatment records, marketing use of photographs or video, electronic communications, or other activities.

Personal Information We Collect

2.1 Information You Provide Directly

Depending on how you interact with us, we may collect:

1. Contact and identity information, such as your name, email address, telephone number, mailing or residential address, city, state, ZIP code, and other contact details.
2. Consultation and inquiry information, including messages, questions, requested services, desired treatment outcomes, hair-loss concerns, and information you choose to provide when requesting a consultation or quote.
3. Photographs and videos, including images of the scalp, hairline, and treated SMP areas submitted through our website or communications, and images created before, during, or after treatment for treatment planning, documentation, quality control, legal or compliance purposes, and, where authorized under the Client Informed Consent and Treatment Agreement, marketing or promotional use.
4. Treatment and health-related information, including information that you voluntarily provide or that is reasonably necessary to evaluate, plan, perform, document, or follow up on SMP services, such as relevant medical history, allergies, medications, skin conditions, prior procedures, healing history, contraindications, information concerning factors that may affect healing or pigment retention, and other information requested in applicable consent, consultation, or intake forms. SMP Masters collects information it reasonably considers relevant to the safety, suitability, performance, documentation, or administration of its services.
5. Appointment and transaction information, including consultation and treatment dates, booking history, deposits, amounts paid, invoices, financing status, and limited payment-related information. Depending on the payment method and provider used, payment card, bank, or financing information may be collected and processed directly by a third-party payment, financing, or financial-services provider rather than stored by SMP Masters. SMP Masters may receive limited transaction information, such as payment status, transaction identifiers, amounts, and related billing information necessary to administer the transaction.
6. Consent, signature, and compliance records, including signed agreements, treatment consents, treatment-specific acknowledgments, marketing/photo and video authorizations, aftercare instructions and related records, final-session design and touch-up acknowledgments, single-use needle and body-art confirmations, and other records required or reasonably necessary to document services, client instructions, applicable legal or regulatory requirements, or SMP Masters’ business practices.
7. Communications with us, including emails, text messages, telephone communications, appointment reminders, support requests, feedback, and other correspondence.
8. Website and consultation information, including information you submit through contact forms, consultation requests, booking inquiries, email communications, or other website features, such as your name, contact information, service preferences, appointment-related information, and the contents of your inquiry.
9. Booking and appointment information, including appointment dates and times, appointment status, rescheduling or cancellation information, service selections, deposit information, and related communications.

Information Collected Automatically

When you use our website, certain information may be collected automatically through cookies, tags, pixels, server logs, and similar technologies. This may include IP address, browser and device type, operating system, referring pages, pages viewed, dates and times of visits, approximate location derived from IP address, and interactions with the website. The information we receive depends on your interaction with those providers and their privacy practices.

How We Use Personal Information

1. Respond to inquiries, provide consultations, evaluate treatment suitability, prepare quotes, and communicate with prospective clients.
2. Schedule, confirm, reschedule, and manage appointments, deposits, treatment sessions, follow-ups, and aftercare communications.
3. Provide SMP and related services, develop treatment plans, document treatment, evaluate healing or pigment retention, maintain treatment records, and address client questions or concerns.
4. Process payments, deposits, refunds where applicable, financing-related interactions, accounting, fraud prevention, and other transaction administration.
5. Send service-related communications, such as appointment confirmations, reminders, scheduling messages, aftercare information, and responses to client requests.
6. Send marketing or promotional communications where permitted by law and consistent with the choices or consent you have provided.
7. Operate, maintain, secure, troubleshoot, and improve our website, services, client experience, and business operations.
8. Analyze website usage and marketing effectiveness through analytics and similar tools.
9. Protect the safety, rights, property, and integrity of SMP Masters, our clients, practitioners, contractors, and others; prevent fraud or misuse; and establish, exercise, or defend legal claims.
10. Comply with applicable licensing, tattoo and body-art, health and safety, recordkeeping, tax, accounting, insurance, legal, regulatory, court-order, subpoena, law-enforcement, and other lawful requirements.
11. Maintain treatment, consent, photographic, transaction, and other business records; document services provided; evaluate healing and pigment retention; administer corrective or touch-up requests; address complaints or disputes; and establish, exercise, or defend legal rights.
12. Administer appointments, deposits, payments, rescheduling and cancellations; communicate with clients regarding their transactions and services; investigate complaints and disputes; and establish, exercise, or defend SMP Masters’ rights and interests.
13. Carry out any other purpose disclosed to you at the time of collection or with your consent.

TREATMENT PHOTOGRAPHS, VIDEOS, AND MARKETING AUTHORIZATION

SMP Masters may create and retain photographs or videos of a Client’s scalp, hairline, and treated SMP areas as reasonably necessary for consultation, treatment planning, procedural documentation, continuity of treatment, evaluation of healing or pigment retention, quality control, treatment records, insurance, legal or regulatory compliance, dispute resolution, and other legitimate treatment or business-record purposes.

Treatment-record photographs and videos are separate from public marketing use. The creation or retention of treatment records does not, by itself, authorize SMP Masters to publish or otherwise use identifiable Client photographs or videos for public advertising, promotional, portfolio, website, social-media, or similar marketing purposes.

Public marketing use of an identifiable Client’s photographs or videos is authorized through the Client’s signed Client Informed Consent and Treatment Agreement. By signing that Agreement, the Client authorizes the photography, recording, reproduction, publication, display, distribution, and other uses specifically described in the marketing authorization contained in Section 18 of that Agreement.

If a Client specifically requests that the Client’s photographs or videos not be used publicly for marketing purposes, SMP Masters will honor that request prospectively to the extent reasonably practicable and permitted by applicable law. Such request will not affect SMP Masters’ ability to create, retain, or use treatment-record photographs or videos for treatment planning, documentation, quality control, insurance, legal or regulatory compliance, recordkeeping, or dispute-resolution purposes.

A request not to use photographs or videos publicly for marketing does not necessarily require SMP Masters to remove or recall materials that were lawfully created, published, distributed, or incorporated into existing materials before the request was received, except where removal is required by applicable law or otherwise agreed in writing.

Cookies, Analytics, and Similar Technologies

Our website may use cookies, pixels, tags, scripts, local storage, server logs, and similar technologies for purposes such as website functionality, security, analytics, measurement, remembering preferences, and, where applicable, advertising or marketing. The specific technologies and third-party providers used on the website may change from time to time. You can control cookies through your browser settings and, where available, through a cookie-consent or preference tool. Blocking certain cookies may affect website functionality. Third-party analytics and advertising providers may process information under their own privacy policies. Email, Telephone, and Text Message Communications

If you provide an email address or telephone number, SMP Masters may use it for service-related communications, including consultation responses, appointment confirmations, scheduling changes, reminders, aftercare information, treatment-related communications, responses to client requests, and other communications relating to an existing or prospective client relationship.

Where required by applicable law, SMP Masters will obtain the consent required before sending marketing or promotional text messages, calls, or other electronic communications. Marketing communications will include an appropriate method for opting out where required by law.

You may opt out of marketing emails by using the unsubscribe method provided in the message. You may opt out of marketing text messages by replying STOP where that functionality is available or by contacting SMP Masters directly. Opting out of marketing communications does not prevent SMP Masters from sending non-marketing communications reasonably necessary to administer an existing appointment, transaction, treatment, or client relationship.

SMP Masters does not sell mobile telephone numbers, text-message opt-in data, or messaging consent information to unaffiliated third parties for their own marketing purposes. SMP Masters may disclose such information to service providers that facilitate the delivery, routing, administration, or management of communications on SMP Masters’ behalf, subject to applicable restrictions.

How We Disclose Personal Information

We may disclose personal information in the following circumstances:

1. Service providers and contractors. We may provide information to vendors that perform services for us, including website hosting, appointment scheduling, payment processing, financing administration, communications, document/e-signature services, cloud storage, analytics, IT/security, accounting, and professional services. SMP Masters seeks to limit disclosures to information reasonably necessary for the applicable purpose and, where appropriate, to require service providers to maintain appropriate confidentiality and security protections.
2. Practitioners and business personnel. Information may be shared with the SMP practitioner, authorized contractors, employees, or personnel who need it to provide services, administer appointments, maintain records, or operate the business.
3. Professional advisers and insurers. We may disclose information to attorneys, accountants, auditors, insurance carriers, brokers, consultants, or other advisers where reasonably necessary.
4. Legal and regulatory disclosures. We may disclose information when required or permitted by law, regulation, subpoena, court order, governmental request, licensing requirement, or to protect rights, safety, property, or legal interests.
5. Business transactions. Information may be transferred in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or similar business transaction, subject to applicable law.
6. With your direction or consent. We may disclose information for another purpose when you direct us to do so or provide consent.

Sale, Sharing, and Targeted Advertising

SMP Masters does not sell personal information to third parties for monetary consideration in the ordinary course of its business. SMP Masters does not sell mobile telephone numbers, text-message opt-in data, or messaging consent information to unaffiliated third parties for their own marketing purposes.

Certain privacy laws may define "sale," "sharing," "targeted advertising," or similar concepts more broadly than a conventional monetary sale. Depending on the technologies and services used on our website and the law applicable to a particular individual, certain disclosures to analytics, advertising, social-media, or similar providers may be subject to additional notice, consent, or opt-out requirements.

Where such requirements apply, SMP Masters will provide the applicable notices and rights required by law and will honor applicable opt-out mechanisms.

Data Security

SMP Masters maintains reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, acquisition, use, alteration, disclosure, or destruction, taking into account the nature of the information and the circumstances in which it is maintained.

Depending on the systems and services involved, safeguards may include access controls, authentication requirements, restricted access to treatment and business records, secure service providers, appropriate encryption or secure transmission methods, administrative policies and training, system and account protections, backup and recovery measures, monitoring or testing appropriate to the environment, and secure disposal practices.

Access to client information is limited to personnel, practitioners, contractors, and service providers who reasonably require access for authorized business, treatment, administrative, legal, regulatory, or other legitimate purposes.

No method of electronic transmission, storage, or security can be guaranteed to be completely secure. Clients should avoid sending highly sensitive information through ordinary email or text message unless specifically requested by SMP Masters and an appropriate method of transmission has been provided.

SMP Masters periodically reviews its information-security practices and may update its safeguards as appropriate to address changes in its systems, service providers, business operations, and reasonably foreseeable security risks.

Data Retention and Disposal

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, and for applicable legal, regulatory, business, insurance, accounting, tax, dispute-resolution, and recordkeeping purposes.

Different categories of information may be retained for different periods. Certain treatment, consent, tattoo/body-art, equipment, insurance, legal, and compliance records may be subject to specific retention requirements. Where applicable law requires a particular retention period, that requirement controls.

A privacy request does not require SMP Masters to delete information that it is legally required or reasonably entitled to retain, including treatment, consent, transaction, compliance, insurance, dispute, or recordkeeping information.

When personal information is no longer required or reasonably necessary to be retained, SMP Masters may securely delete, destroy, or de-identify the information in accordance with applicable law, contractual obligations, insurance requirements, litigation holds, and its records-management practices.

Your Choices and Privacy Rights

Depending on where you live and which privacy laws apply to SMP Masters’ processing of your personal information, you may have certain rights concerning your personal information. These rights may include, where applicable, the right to request access to or correction of certain information, request deletion or a copy of certain information, obtain portability of certain information, or opt out of certain processing activities, including certain targeted advertising, sale, or sharing activities.

These rights are not available in all circumstances and may be subject to statutory exceptions, identity-verification requirements, legal or regulatory recordkeeping obligations, contractual obligations, security requirements, legitimate business needs, litigation holds, and other limitations permitted by law.

You may also update your communication preferences or withdraw certain prospective consents by contacting SMP Masters. Withdrawal of consent does not necessarily affect processing that occurred before withdrawal or processing that SMP Masters is otherwise permitted or required to conduct under applicable law.

A privacy request will not require SMP Masters to delete or alter information that SMP Masters is legally required or reasonably entitled to retain, including treatment, consent, transaction, compliance, insurance, dispute, or recordkeeping information.

To submit a privacy request, contact us using the information in Section 16. SMP Masters may need to verify your identity before completing a request and may request additional information reasonably necessary to process the request. Where applicable law provides a right to appeal or otherwise challenge a privacy-request decision, SMP Masters will provide the process required by that law.

You may also contact SMP Masters to request information about the categories of personal information we maintain about you or to request correction of inaccurate contact or account information, subject to applicable law, any applicable statutory exceptions, and verification requirements.

Third-Party Websites and Services

Our website and communications may contain links to or integrations with third-party services, including booking, payment, financing, maps, social-media, review, analytics, or other platforms. SMP Masters is not responsible for the privacy or security practices of third parties we do not control. Please review the privacy policies and terms of those services before providing information to them. Your interactions with a third-party service may also be governed by that third party’s privacy policy, terms, and consent mechanisms.

Children’s Privacy

SMP Masters’ website and services are not directed to minors under eighteen (18), and SMP Masters provides tattooing and scalp micropigmentation services only to persons eighteen (18) years of age or older.

If SMP Masters knows that a website user is under eighteen (18), SMP Masters will process that user’s personal information only as permitted by applicable law, including any applicable restrictions on processing personal information of known minor users.

SMP Masters does not knowingly collect personal information online from children under thirteen (13) except as permitted by applicable law.

If SMP Masters determines that it has collected personal information from a minor in circumstances in which the information may not lawfully be processed, SMP Masters will take reasonable steps to address the information in accordance with applicable law.

Data Incidents and Breach Notification

SMP Masters maintains procedures designed to identify, assess, contain, investigate, and respond to suspected security incidents involving personal information.

If SMP Masters determines that a security incident has resulted in unauthorized access to or acquisition of information requiring notification under applicable law, SMP Masters will provide notices to affected individuals, governmental authorities, regulators, law enforcement, or other parties as required by applicable law and within the time periods required by applicable law.

SMP Masters may delay notification where permitted by law, including where notification would impede a lawful investigation or otherwise fall within a statutory exception.

Nothing in this Section creates a contractual obligation to provide notice where applicable law does not require notice.

Changes to This Privacy Policy

SMP Masters may update this Privacy Policy from time to time to reflect changes in its business practices, services, technology, service providers, legal requirements, or privacy practices.

The updated version will be posted on our website with a revised effective or "Last Updated" date. Changes will apply prospectively unless otherwise permitted by applicable law.

A change to this Privacy Policy does not modify or revoke a previously signed treatment consent, marketing authorization, treatment-specific acknowledgment, or other written authorization unless the applicable authorization itself permits such modification or the client provides a new authorization where required.

Where applicable law requires additional notice, consent, or other procedures for a material change, SMP Masters will follow those requirements.
