Website: bestscalpmicro.com | Phone: 929-492-1144 | Email: info@smpmasters.com

These Terms of Service ("Terms") govern access to and use of the SMP Masters website, appointment-booking channels, consultations, scalp micropigmentation and related cosmetic services, and other services offered by SMP Masters Inc. ("SMP Masters," "we," "us," or "our"). By accessing the website, booking an appointment, paying a deposit, signing a client agreement, or receiving Services, you ("Client," "you," or "your") agree to these Terms.

ACCEPTANCE AND INCORPORATED DOCUMENTS

These Terms of Service (“Terms”) establish the general commercial terms governing the relationship between SMP Masters Inc. (“SMP Masters,” “we,” “us,” or “our”) and each Client in connection with SMP Masters’ website, appointment-booking channels, consultations, scalp micropigmentation and related cosmetic services, payments, scheduling, communications, and other services offered by SMP Masters.

If there is a conflict concerning treatment-specific informed consent, treatment risks, procedural matters, treatment design, treatment-record photography, marketing authorization, or other treatment-specific matters, the signed Client Informed Consent and Treatment Agreement controls. If there is a conflict concerning booking, deposits, payments, scheduling, cancellation, rescheduling, late arrivals, no-shows, or other general commercial or business terms, these Terms control. Privacy matters are governed by the Privacy Policy, except that a specific affirmative authorization or acknowledgment contained in the signed Client Informed Consent and Treatment Agreement controls with respect to the subject matter specifically addressed in that authorization or acknowledgment. Any written booking confirmation or written price quote controls only with respect to the specific price, scope, or appointment information expressly stated in it.

SERVICES AND LOCATIONS

SMP Masters provides elective cosmetic scalp micropigmentation (SMP), scar camouflage, density treatment, consultations, touch-ups, repair/correction services, and related cosmetic pigmentation services. SMP is cosmetic and is not medical treatment.

Our primary New York City service location is 481 8th Avenue, Suite 1137, New York, NY 10001. We may also provide Services at other authorized locations disclosed to the Client at booking. Appointment location, date, and time are not final until confirmed by SMP Masters in writing.

ELIGIBILITY AND HEALTH DISCLOSURE

Clients must be at least eighteen (18) years old to receive SMP treatment from SMP Masters. Clients must provide accurate identifying and health information relevant to treatment.

You are responsible for disclosing medical conditions, medications, allergies, skin conditions, bleeding or immune issues, and other information that could reasonably affect treatment safety or healing. SMP Masters may postpone, refuse, or discontinue treatment when, in its professional judgment, treatment may be inappropriate or medical clearance should be obtained.

Treatment-specific health disclosures, informed consent, treatment risks, and related acknowledgments are governed by the Client Informed Consent and Treatment Agreement.

APPOINTMENTS AND CONFIRMATION

SMP Masters operates by appointment only. Appointment requests are subject to availability and are not confirmed until SMP Masters accepts the appointment and, when required, receives the applicable deposit.

No artist, contractor, employee, or representative has authority to waive a deposit, pricing term, cancellation rule, touch-up policy, or other material term unless the exception is confirmed in writing by SMP Masters.

DEPOSITS

Where a deposit is quoted or required, the appointment is not secured until the deposit is received. Deposits are applied toward the scheduled treatment balance and are non-refundable except where otherwise required by law or expressly agreed by SMP Masters in writing.

A deposit reserves appointment time, artist availability, equipment, preparation, and administrative resources. SMP Masters may, in its discretion and subject to Section 6, permit a deposit to be transferred to a rescheduled appointment. Any additional deposit required under the rescheduling policy is also applied toward the applicable treatment balance unless otherwise stated in writing, and is subject to the same non-refundable terms as the original deposit. A transfer or exception is an accommodation and does not create a right to future transfers or refunds.

CANCELLATION, RESCHEDULING, NO-SHOWS, AND LATE ARRIVALS

Client may reschedule an appointment up to three (3) times under the same booking and deposit, subject to the cancellation and no-show provisions below. Client-requested reschedules are counted cumulatively for that booking. Rescheduling initiated by SMP Masters does not count toward this limit. If the Client requests a fourth reschedule, a new deposit is required to secure the appointment. Any new deposit will be applied toward the applicable treatment balance and will be subject to the same non-refundable terms as the original deposit, unless otherwise stated in writing.

Unless otherwise stated in writing, appointments may be rescheduled without penalty when SMP Masters receives at least 48 hours’ notice. Late cancellations and no-shows are governed separately from the three-reschedule allowance and may result in forfeiture of the existing deposit and/or require a new deposit before another appointment is scheduled.

PRICING AND PAYMENT

Prices may be posted on our website, provided during consultation, or quoted individually. A written quote for a defined treatment scope controls that treatment unless it expires, is modified by mutual written agreement, or the requested scope materially changes.

Fees are stated in U.S. dollars. Unless otherwise agreed in writing, the remaining balance is due no later than the scheduled procedure. Treatment fees are non-refundable once treatment has begun, subject to rights that cannot lawfully be waived. Nothing in this Section limits any refund or cancellation right that cannot lawfully be waived.

SMP Masters may offer financing through third-party providers. Third-party financing is governed by the provider’s separate terms, and SMP Masters is not responsible for the provider’s credit decisions, fees, or account administration.

PHOTOGRAPHY AND MARKETING

Photography and recording rights relating specifically to treatment records and public marketing are governed by Sections 17 and 18 of the Client Informed Consent and Treatment Agreement. The Client’s execution of that Agreement constitutes the Client’s written authorization for the photography, recording, and marketing uses described in Section 18, subject to the terms and limitations stated there.

Nothing in these Terms limits SMP Masters’ ability to create, retain, or use treatment-record photographs or recordings as permitted under Section 17 of the Client Informed Consent and Treatment Agreement and applicable law.

TREATMENT EXPECTATIONS AND NO GUARANTEE

SMP results vary from person to person. Skin type, scar tissue, treatment area, pigment retention, immune response, lifestyle, aftercare, sun exposure, prior procedures, and individual healing may materially affect the outcome.

No specific cosmetic appearance, exact pigment-retention percentage, precise number of sessions, complete concealment of a scar or hair-loss pattern, permanent color stability, or future subjective satisfaction is guaranteed.

Examples, simulations, before-and-after photographs, and descriptions of past results are illustrative only and are not guarantees of an individual Client’s outcome.

Treatment-specific acknowledgments, risks, design approvals, and informed-consent provisions are governed by the Client Informed Consent and Treatment Agreement.

TREATMENT PLAN AND NUMBER OF SESSIONS

The number of sessions discussed or quoted represents the anticipated treatment plan based on the information available at consultation. Some Clients may require fewer or additional sessions because of healing, pigment retention, scar tissue, treatment complexity, or other individual factors.

A quoted treatment package applies only to the originally agreed treatment area and design unless SMP Masters confirms an expanded scope in writing.

FINAL DESIGN APPROVAL

SMP is an aesthetic procedure requiring subjective design choices. The Client is expected to communicate preferences regarding hairline position, shape, softness or definition, density, treatment boundaries, scar camouflage, and overall appearance during the treatment course.

The final scheduled session of the agreed treatment plan is the Client’s opportunity to communicate reasonable final aesthetic adjustments to the agreed design. Once the original treatment design has been completed, later changes in aesthetic preference may be treated as additional services rather than corrective work.

At the Client’s final scheduled treatment session, SMP Masters may provide a separate Final-Session Design & Touch-Up Acknowledgment documenting the Client’s opportunity to communicate reasonable final adjustments to the agreed design and the applicable post-treatment corrective-touch-up policy.

HEALING, PIGMENT RETENTION, AND AFTERCARE

SMP cannot be evaluated solely by its appearance immediately after treatment. Pigment changes during healing, and individual impressions may lighten or retain differently. Minor variation in retention is an inherent characteristic of SMP and does not, by itself, establish improper treatment.

Clients must follow the written and verbal aftercare instructions provided by SMP Masters following treatment. Failure to follow aftercare may materially affect the result and may disqualify a requested complimentary touch-up if the issue is reasonably attributable to noncompliance.

COMPLIMENTARY CORRECTIVE TOUCH-UPS

A complimentary corrective touch-up is a limited customer-service correction within an area already treated. It is not an additional SMP session and is not an opportunity to redesign or expand the original procedure.

A complimentary corrective touch-up is intended only to address a qualifying minor issue arising within the previously treated area. It does not guarantee that SMP Masters will perform corrective work, and any requested work remains subject to evaluation and approval by SMP Masters.

When approved by SMP Masters, a complimentary touch-up may address isolated pigment impressions that failed to retain as reasonably expected, small areas that healed materially lighter than surrounding treated areas, minor inconsistencies, or limited incomplete blending of a previously treated area, including scar camouflage.

A complimentary touch-up does not include:

  • moving the hairline forward or backward;
  • changing or redesigning the hairline shape;
  • substantially increasing overall density;
  • adding new treatment areas or expanding the original treatment boundaries;
  • changing a previously approved aesthetic style;
  • performing substantial additional work equivalent to another treatment session; or
  • maintenance attributable to ordinary fading over time.

The eligibility and scope of any complimentary touch-up are also subject to the terms of the Client Informed Consent and Treatment Agreement.

TOUCH-UP REQUEST PERIOD

Any request for evaluation of a complimentary corrective touch-up must be submitted within thirty (30) calendar days from the date of the Client’s final scheduled treatment session. The thirty-day period is measured from the date of the final scheduled treatment session and is not extended by aftercare, healing, the date on which the Client first notices an issue, or the date on which the Client becomes dissatisfied with the result.

A timely request gives the Client the right to an evaluation only and does not automatically entitle the Client to complimentary corrective work. SMP Masters may require sufficient healing and current photographs or other information reasonably necessary to evaluate the request before determining whether the requested work qualifies as a complimentary corrective touch-up.

Whether requested work qualifies as a complimentary touch-up will be determined by SMP Masters based on the healed condition, original treatment scope, photographs, treatment records, aftercare compliance, and the nature and extent of the requested work.

The actual appointment may occur after the 30-day request period if the request was made on time and scheduling requires a later date.

UNUSUAL HEALING OR POOR PIGMENT RETENTION

Some Clients may experience unusual healing or pigment retention requiring substantially more treatment than would ordinarily constitute a minor touch-up. SMP Masters may recommend additional treatment after evaluating the healed result.

The need for additional treatment does not automatically make that treatment complimentary. Work requiring substantially the time or scope of another treatment session may be treated and priced as an additional session, even when the need for further work is associated with unusual healing or retention.

SMP Masters may voluntarily reduce or waive a fee in a particular case. Any accommodation is discretionary, is not an admission that prior work was defective, and does not create a precedent or entitlement for future services.

The evaluation of unusual healing or pigment retention does not extend or restart the thirty (30)-day request period set forth in Section 14.

ADDITIONAL, OUT-OF-SCOPE, AND MAINTENANCE SERVICES

Requests for additional density, new treatment areas, changes to an established hairline, significant modification of previously approved SMP, additional scar camouflage, repair of another provider’s work, or substantial additional sessions are separate services and may require additional payment.

SMP pigment naturally changes and fades over time. Future refreshing, color adjustment, density enhancement, maintenance, or later touch-up work is a separate service subject to SMP Masters’ then-current pricing.

CLIENT CONDUCT AND RIGHT TO REFUSE SERVICE

Clients must treat staff, artists, contractors, other clients, and building personnel respectfully; arrive sober and able to consent; provide truthful information; and comply with reasonable safety and facility rules.

SMP Masters may refuse, suspend, or discontinue service for safety concerns, abusive or threatening conduct, suspected fraud, material misrepresentation, repeated policy violations, inability to obtain informed consent, or other reasonable business or safety reasons, subject to applicable law.

CLIENT REVIEWS, PUBLIC STATEMENTS, AND FALSE INFORMATION

Nothing in these Terms restricts a Client’s right to express an honest opinion, provide truthful feedback, or publish a lawful review concerning the Client’s genuine experience with SMP Masters.

Clients may not knowingly publish or communicate materially false statements of fact concerning SMP Masters, its owners, artists, contractors, employees, credentials, facilities, business practices, treatment, or Services.

Nothing in these Terms waives or limits SMP Masters’ rights or remedies concerning statements or content that are knowingly false, fraudulent, fabricated, defamatory, impersonated, threatening, harassing, unlawful, or falsely represented as arising from a genuine customer experience.

SMP Masters reserves the right to document, respond to, report, seek correction or removal of, or otherwise pursue lawful remedies regarding content it reasonably believes violates applicable law or the policies of the platform on which the content appears.

A disagreement regarding subjective opinion or cosmetic preference does not, by itself, constitute a false statement of fact.

WEBSITE USE AND INTELLECTUAL PROPERTY

All website content, branding, logos, copy, photographs, graphics, videos, designs, and other materials are owned by or licensed to SMP Masters and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial purposes only. You may not reproduce, republish, commercially exploit, scrape, reverse engineer, interfere with, or misuse the website or its content except as permitted by law or with SMP Masters’ written permission.

PRIVACY AND RECORDS

SMP Masters may collect and process information reasonably necessary to provide Services, operate the website, communicate with Clients, maintain records, process payments, protect legal rights, and comply with applicable law. Additional details concerning the collection, use, disclosure, retention, security, and handling of Client information are governed by SMP Masters’ Privacy Policy, as amended from time to time.

Treatment-related photographs and records may be retained for the period reasonably necessary for treatment, legal compliance, insurance, business documentation, and dispute-resolution purposes.

The Privacy Policy is incorporated by reference into these Terms. In the event of a conflict between the Privacy Policy and the signed Client Informed Consent and Treatment Agreement concerning treatment-specific consents or authorizations, the signed Client Informed Consent and Treatment Agreement controls.

DISCLAIMERS AND LIMITATION OF LIABILITY

SMP Masters provides cosmetic, not medical, services. Website content is general information and does not constitute medical diagnosis or treatment advice.

To the fullest extent permitted by law, SMP Masters is not responsible for loss or damage caused by materially inaccurate Client disclosures, failure to follow aftercare, unauthorized treatment or modification by another provider, Client conduct that materially interferes with healing, or ordinary disclosed risks inherent in SMP that are not caused by legally actionable misconduct of SMP Masters.

The website is provided on an "as is" and "as available" basis. Nothing in these Terms excludes or limits liability, rights, or remedies that cannot lawfully be excluded or limited.

To the fullest extent permitted by applicable law, and except for liability that cannot lawfully be limited or excluded, SMP Masters shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the Services or these Terms, except to the extent such damages cannot lawfully be excluded.

Nothing in this Section limits liability for fraud, gross negligence, willful misconduct, or any other liability that cannot lawfully be limited or excluded.

INDEMNIFICATION

To the fullest extent permitted by applicable law, Client shall be responsible for third-party claims, damages, losses, liabilities, and reasonable costs arising directly from Client’s unlawful use of the website or Services, Client’s material breach of these Terms, or Client’s violation of another person’s rights, except to the extent caused by SMP Masters’ own negligence, willful misconduct, or other legally actionable conduct. Nothing in this Section requires Client to indemnify SMP Masters for SMP Masters’ own negligence, willful misconduct, or other liability that cannot lawfully be shifted to Client.

CUSTOMER-SERVICE ACCOMMODATIONS

SMP Masters may voluntarily provide additional work, waive or reduce a fee, transfer a deposit, or make another accommodation in a particular case. An accommodation applies only to that circumstance and does not modify these Terms, constitute an admission of fault, create an entitlement to future complimentary treatment, or require SMP Masters to provide the same accommodation to any other Client.

  1. NOTICE OF DISPUTE; OPPORTUNITY TO CURE

Before commencing arbitration or litigation concerning a dispute arising out of or relating to these Terms, a booking, or the Services, the Client must provide SMP Masters with written notice describing the nature of the dispute, the material facts supporting the claim, and the specific relief requested. Notice must be sent to info@smpmasters.com or by certified mail to SMP Masters Inc., 481 8th Avenue, Suite 1137, New York, NY 10001. SMP Masters will have thirty (30) calendar days after receipt of the notice to investigate the matter and, where reasonably appropriate, offer a resolution or cure. The parties will thereafter make a good-faith effort to resolve the dispute informally before initiating formal proceedings. Where appropriate and legally permissible, the parties may also attempt to resolve the dispute through mediation before commencing arbitration or litigation. Nothing in this Section prevents either party from seeking emergency, temporary, or other relief that cannot reasonably await expiration of the notice-and-cure period or that applicable law permits to be sought immediately.

  1. INDIVIDUAL ARBITRATION:

Except for matters that applicable law permits or requires to be brought in court, including qualifying small-claims matters and requests for temporary or preliminary injunctive relief, any dispute, claim, or controversy arising out of or relating to these Terms, any booking, or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and Mediation Procedures then in effect.

To the extent applicable and enforceable, the parties intend that the Federal Arbitration Act, 9 U.S.C. §§ 1–16, govern the interpretation and enforcement of this arbitration provision.

The arbitration shall be conducted by one neutral arbitrator. The arbitration may be conducted remotely, by documents only where permitted by the applicable AAA Rules, or in New York County, New York, unless the parties agree otherwise or applicable law requires another location or procedure.

The arbitrator shall permit only discovery reasonably necessary to resolve the claims and shall have authority to limit duplicative, cumulative, burdensome, or disproportionate discovery consistent with applicable law and the AAA Rules.

The arbitrator may award any individual remedy available under applicable law, subject to the limitations and exclusions contained in these Terms and the Client Informed Consent and Treatment Agreement to the extent enforceable.

Nothing in this Section requires a Client to pay arbitration fees or costs in excess of those permitted under applicable law or the applicable AAA Consumer Arbitration Rules.

If applicable law prohibits mandatory arbitration of a particular claim or requires that claim to be heard in court or another forum, that claim shall not be subject to mandatory arbitration, and the remainder of this arbitration provision shall remain enforceable to the fullest extent permitted by law.

The parties acknowledge that the Services and the transactions contemplated by these Terms may involve interstate commerce, including through interstate communications, payment processing, financing, technology, vendors, or other services or transactions extending beyond the State of New York. To the extent the transaction evidences a transaction involving interstate commerce, the parties intend that the Federal Arbitration Act, 9 U.S.C. §§ 1–16, govern the interpretation and enforcement of this arbitration provision.

To the fullest extent permitted by applicable law, the arbitrator shall have authority to determine questions concerning the interpretation, applicability, enforceability, or scope of this arbitration provision, including whether a particular dispute is arbitrable, except for matters that applicable law requires a court to determine.

  1. JURY TRIAL WAIVER

To the fullest extent permitted by applicable law, each party knowingly and voluntarily waives any right to trial by jury in any court proceeding arising out of or relating to these Terms, a booking, or the Services, except to the extent such waiver is prohibited or rendered inapplicable by applicable law.

  1. CLASS, COLLECTIVE, CONSOLIDATED, AND REPRESENTATIVE ACTION WAIVER

To the fullest extent permitted by applicable law, any dispute subject to arbitration shall be brought and resolved solely on an individual basis. Neither the Client nor SMP Masters may participate in, initiate, maintain, or seek relief through any class, collective, consolidated, mass, private-attorney-general, representative, or similar proceeding concerning a dispute subject to arbitration.

The arbitrator shall have no authority to combine claims, conduct a class or representative proceeding, or award relief to or on behalf of persons other than the individual parties to the arbitration, except to the extent applicable law requires otherwise. If any portion of this waiver is determined unenforceable as to a particular claim or remedy, the remaining portions shall remain enforceable to the fullest extent permitted by law.

  1. ATTORNEYS’ FEES AND COSTS

Each party shall bear its own attorneys’ fees except to the extent an award of attorneys’ fees, costs, or expenses is authorized by applicable law, the applicable AAA Rules, or a written agreement between the parties. To the fullest extent permitted by applicable law, the arbitrator or court may award SMP Masters its reasonable attorneys’ fees and costs incurred in defending against a claim or proceeding that is determined to have been brought in bad faith, for purposes of harassment, or that is frivolous, vexatious, or otherwise subject to fee-shifting under applicable law or the governing AAA Rules.

Nothing in this Section creates a right to recover attorneys’ fees where applicable law or the governing arbitration rules would not permit such recovery.

GOVERNING LAW

Except to the extent superseded by applicable federal law, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. To the extent the Federal Arbitration Act applies to the arbitration provision, the FAA shall govern the interpretation and enforcement of that provision.

CHANGES TO THESE TERMS

SMP Masters may update these Terms from time to time. The current version will be posted on bestscalpmicro.com with an updated effective date. Changes apply prospectively unless applicable law permits otherwise. Material terms governing an appointment already booked will not be retroactively changed in a manner that unlawfully impairs an accrued Client right. Changes to these Terms do not modify a previously signed Client Informed Consent and Treatment Agreement unless expressly agreed to in writing and permitted by applicable law.

SEVERABILITY AND NO WAIVER

If any provision of these Terms is determined to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable where permitted by law, or otherwise severed, and the remainder will remain in effect.

Failure to enforce a provision on one occasion is not a waiver of the right to enforce that provision on another occasion. If any portion of the arbitration, class-action waiver, jury waiver, fee-shifting, limitation-of-liability, or indemnification provisions is held unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

ENTIRE AGREEMENT; NO ORAL MODIFICATION

These Terms, together with the incorporated documents described in Section 1 and any applicable written booking or treatment-specific agreement, constitute the agreement between SMP Masters and the Client concerning the subject matter addressed. The order of precedence stated in Section 1 applies in the event of any conflict among these documents.

Informal conversations or oral statements do not modify deposit requirements, pricing, treatment scope, touch-up rights, cancellation rules, or other material terms. Any material exception or modification must be confirmed in writing by SMP Masters. Nothing in these Terms is intended to supersede a more specific treatment-related provision of the signed Client Informed Consent and Treatment Agreement or a more specific privacy provision of the Privacy Policy.

SMS TERMS

Service and informational SMS

If you separately opt in to service and informational SMS through the optional service SMS checkbox on an SMP Masters form, you agree to receive recurring messages related to your consultation request, appointment confirmations and reminders, scheduling, service updates, aftercare, and responses to your request. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is not a condition of purchase.

Marketing and promotional SMS

Marketing consent is collected separately from service and informational consent. If you separately opt in to marketing SMS, you agree to receive recurring promotional messages from SMP Masters, including occasional offers and service promotions. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Marketing consent is optional and is not a condition of purchase.

Both SMS choices are optional. You can submit an inquiry, book, or purchase without agreeing to either type of SMS. Replying STOP stops SMS from this program until you opt in again. Carriers are not liable for delayed or undelivered messages. SMP Masters may use service providers to facilitate message delivery and administration. We do not sell or share SMS opt-in data or personal information with third parties for marketing purposes. See our Privacy Policy at https://bestscalpmicro.com/privacy-policy/.

ELECTRONIC COMMUNICATIONS AND SIGNATURES

These Terms do not enroll you in SMS. Service SMS and marketing SMS each require their own separate optional opt-in. For non-SMS communications, you consent to receiving appointment-related and service-related communications electronically at the contact information you provide. Electronic signatures, acknowledgments, checkboxes, and electronic acceptance may be treated as original signatures to the fullest extent permitted by law.

No separate signature to these Terms is required where Client provides the affirmative electronic acceptance described below, unless SMP Masters elects to require one. Where applicable law requires a particular form of consent, disclosure, signature, confirmation, or delivery, SMP Masters will use the form and procedure required by applicable law.

Where these Terms are presented electronically at or before booking, Client’s acceptance shall be obtained through a conspicuous affirmative acknowledgment or other affirmative acceptance mechanism requiring Client to confirm that Client has reviewed and agrees to these Terms, including the dispute-resolution, arbitration, jury-trial waiver, and class/collective/representative-action waiver provisions. Mere booking, payment, receipt of Services, or passive access to the website shall not, by itself, constitute affirmative assent to the arbitration provisions.
